Terms of Service

Welcome to Eko Car Rental. These Terms of Service ("Terms") govern your access to and use of the Eko Car Rental website, mobile application, and related services (collectively, the "Platform") operated by Eko Car Rental Ltd ("Eko," "we," "us," or "our").

By accessing or using the Platform, creating an account, or completing a booking, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

To use the Eko Car Rental Platform, you must:

• Be at least 18 years of age (or 21 years for certain vehicle categories)
• Hold a valid government-issued driver's licence in the applicable jurisdiction
• Provide accurate, complete, and current registration information
• Not be prohibited from using our services under applicable laws
• Have a valid payment method on file

Eko reserves the right to verify your eligibility at any time and to refuse or terminate service to any user who does not meet these requirements.

To access most features of the Platform, you must register an account. You agree to:

• Provide truthful and accurate information during registration
• Keep your account credentials confidential and secure
• Notify us immediately of any unauthorised access to your account at security@ekocarrental.com
• Accept responsibility for all activity that occurs under your account

We may verify your identity, driving licence, and payment information before confirming your registration or before processing a booking.

When you make a booking through the Platform, you enter into a direct rental agreement for the vehicle. The following applies:

• Real-time availability: Vehicles are subject to availability at the time of booking
• Confirmation: A booking is only confirmed once you receive a Booking Confirmation email with a reference number
• Check-in: You must present a valid ID and your booking reference at pickup
• Late returns: Late returns may be charged at the applicable hourly or daily rate plus an administrative fee
• No-show: Failure to collect a vehicle without prior notice within 1 hour of the scheduled pickup time may result in cancellation and forfeiture of the booking fee

Eko reserves the right to substitute a vehicle of equal or superior class if your reserved vehicle is unavailable due to unforeseen circumstances.

All prices displayed on the Platform are in United States Dollar (USD) unless otherwise stated. By completing a booking, you authorise Eko to charge your payment method for the total amount shown at checkout.

Fees may include:

• Base rental rate (daily or hourly)
• Insurance and protection packages
• Fuel surcharges (for pre-paid fuel options)
• Driver service fees
• Security deposit (held and released after a damage-free return)
• Late return, toll, or traffic penalty fees

Our cancellation policy is as follows:

Refunds are processed to your original payment method and may take 5–10 business days to appear, depending on your bank.

When using a vehicle booked through our Platform, you agree to:

• Operate the vehicle only within permitted geographic boundaries specified at booking
• Not permit unlicensed or unauthorised drivers to operate the vehicle
• Not use the vehicle for any illegal purpose, racing, or off-road driving
• Not transport hazardous materials, controlled substances, or engage in trafficking
• Return the vehicle in the same condition it was received (reasonable wear excepted)
• Report any accident, damage, or theft to us and local authorities immediately
• Respect all local traffic laws, speed limits, and regulations

All vehicles listed on the Platform carry third-party liability insurance as required by law. Additional insurance and collision damage waiver (CDW) options may be purchased at checkout.

Eko Car Rental is not liable for:

• Personal belongings left in the vehicle
• Indirect, consequential, or incidental damages arising from vehicle use
• Delays caused by traffic, road conditions, or force majeure events
• Damage resulting from reckless or prohibited use of the vehicle

Your liability for damage to the vehicle is limited to the excess amount stated at booking, unless damage resulted from breach of these Terms, fraud, or wilful misconduct.

All content on the Platform, including the Eko Car Rental name, logo, trademarks, website design, software, text, images, and video, is owned by or licensed to Eko Car Rental Ltd and is protected by local and international intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, or commercially exploit any content from the Platform without our express written permission.

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Platform, you consent to our data practices as described therein.

Eko may suspend or permanently terminate your account at any time, with or without notice, for:

• Violation of these Terms
• Providing false or fraudulent information
• Non-payment of outstanding amounts
• Behaviour that endangers drivers, passengers, or third parties
• Any activity that Eko determines, at its sole discretion, to be harmful to the Platform

Upon termination, your right to access the Platform ceases immediately. Outstanding obligations (e.g., damage costs, unpaid fees) survive termination.

These Terms are governed by and construed in accordance with the laws of the Antigua and Barbuda. Any disputes arising from or related to these Terms shall be resolved exclusively in the courts of Antigua and Barbuda.

We encourage you to contact us first to resolve any dispute amicably before resorting to legal action.

We reserve the right to modify these Terms at any time. Material changes will be communicated via email to your registered address or through a prominent notice on the Platform at least 14 days before they take effect.

Your continued use of the Platform after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree, you must discontinue use of the Platform.
